By registering an account, purchasing an evaluation program, accessing our platform, or utilizing any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree with any provision contained herein, you must immediately cease all use of our Service and refrain from accessing our platform.
2. Eligibility and User Qualifications
To access and use our Service, you must meet the following requirements: (a) You must be at least 18 years of age or the age of majority in your jurisdiction of residence, whichever is greater; (b) You must possess the legal capacity to enter into binding contracts under applicable law; (c) You must not be located in, or a resident of, any jurisdiction where our services are prohibited, restricted, or illegal under local, state, national, or international law; (d) You must not be listed on any government sanctions list or prohibited parties list; (e) You agree to comply with all applicable laws, regulations, and regulatory requirements in your jurisdiction, including but not limited to tax obligations, anti-money laundering (AML) regulations, and know-your-customer (KYC) procedures. We reserve the right to verify your identity and eligibility at any time and may request additional documentation to confirm compliance with these requirements.
3. Nature of Services and No Financial Advice
FxLvl operates as a proprietary trading evaluation and education platform. Our services include: (a) Providing simulated trading environments for evaluation purposes; (b) Offering educational resources, market analysis tools, and performance tracking systems; (c) Granting access to live trading accounts for qualified traders who successfully complete our evaluation programs; (d) Facilitating profit withdrawals for traders operating within our established risk parameters. IMPORTANT DISCLAIMER: FxLvl does not provide investment advice, financial planning services, portfolio management, brokerage services, or any form of regulated financial advisory services. Nothing on our platform, website, communications, educational materials, or any content provided by our employees, contractors, affiliates, or representatives should be construed as financial, investment, tax, or legal advice. All trading decisions are made independently by you, and you bear sole responsibility for the outcomes of your trading activities. You should consult with qualified financial, legal, and tax professionals before engaging in any trading activity.
4. Evaluation Programs and Trading Accounts
Upon purchasing an evaluation program, you will receive access to a simulated trading environment designed to assess your trading skills, risk management capabilities, and adherence to our trading rules. The following conditions apply: (a) Simulated Environment: Evaluation accounts operate in a simulated environment and do not involve real capital deployment or live market execution during the evaluation phase; (b) Performance Assessment: Your trading performance is continuously monitored and evaluated based on profit targets, drawdown limits, trading consistency, and compliance with our established rules; (c) No Real Market Exposure: Trades executed during the evaluation phase do not result in real market positions and are used solely for assessment purposes; (d) Non-Refundable Fees: All evaluation program fees are non-refundable once access has been granted and the challenge has been activated. This includes situations where you fail to meet performance targets, violate trading rules, or choose to discontinue participation; (e) Live Account Access: Upon successful completion of evaluation requirements, you may be granted access to a live trading account, subject to final verification, KYC/AML compliance, and acceptance of additional terms specific to live trading operations.
5. Fair Use Policy and Trading Integrity
You agree to use our platform in good faith and in accordance with industry best practices. The following activities are strictly prohibited and will result in immediate account termination without refund: (a) Latency Arbitrage: Exploiting price feed delays, server latency differences, or time discrepancies between data providers to gain unfair advantage; (b) Price Manipulation: Engaging in reverse arbitrage, tick scalping during low liquidity periods, or exploiting platform vulnerabilities to manipulate pricing; (c) Unauthorized Software: Using unlicensed Expert Advisors (EAs), third-party trading bots, unauthorized plugins, or any automated systems not explicitly approved by FxLvl; (d) Account Coordination: Coordinating trades with other users, operating multiple accounts to hedge positions, or engaging in any form of collaborative trading designed to exploit our risk management systems; (e) System Exploitation: Abusing demo account features, exploiting technical glitches, manipulating order execution, or intentionally taking advantage of platform errors or malfunctions; (f) Data Manipulation: Providing false information, creating fake accounts, using VPNs to circumvent geographic restrictions, or misrepresenting your identity or trading history. We employ advanced monitoring systems, artificial intelligence algorithms, and manual review processes to detect prohibited activities. Any violation will result in permanent disqualification from all current and future programs without refund or compensation.
6. Prohibited Conduct and User Obligations
In addition to the trading integrity requirements outlined above, you agree not to: (a) Violate any applicable local, state, national, or international laws or regulations; (b) Engage in abusive, threatening, harassing, defamatory, or discriminatory conduct toward FxLvl staff, other users, or any third parties; (c) Provide false, misleading, or deceptive information during registration, verification, or any communication with our team; (d) Attempt to gain unauthorized access to our systems, servers, databases, or any portion of the Service not intended for public access; (e) Interfere with, disrupt, or compromise the security, integrity, or performance of our platform or infrastructure; (f) Reverse engineer, decompile, disassemble, or attempt to derive source code from our proprietary software or systems; (g) Use our Service to transmit viruses, malware, or any harmful code; (h) Circumvent, disable, or interfere with security features, authentication mechanisms, or payment processing systems; (i) Engage in any activity that could damage FxLvl's reputation, business operations, or relationships with third-party service providers; (j) Copy, reproduce, distribute, or publicly display any proprietary content, trademarks, or intellectual property without express written permission.
7. Account Termination and Suspension Rights
FxLvl reserves the absolute right, in our sole discretion, to suspend, terminate, or permanently ban your access to the platform and all associated services at any time, with or without notice, and without obligation to provide refunds or compensation, under the following circumstances: (a) Violation of any provision of these Terms; (b) Suspected fraudulent activity, unauthorized account access, or security concerns; (c) Initiation of chargebacks, payment disputes, or fraud claims against FxLvl without prior good-faith attempt to resolve the matter directly with our support team; (d) Failure to comply with KYC/AML verification requirements or requests for additional documentation; (e) Providing false or misleading information at any stage of your relationship with FxLvl; (f) Engaging in conduct that, in our reasonable judgment, poses a risk to our business operations, other users, or third-party partners. Automatic Permanent Ban: Any user who initiates a chargeback, files a fraudulent payment dispute, or makes false claims to payment processors will be immediately and permanently banned from all FxLvl services, with all pending payouts forfeited and legal action potentially pursued to recover damages and legal fees.
8. Third-Party Access and Service Providers
FxLvl may engage qualified third-party contractors, developers, technical support providers, and service partners to facilitate platform maintenance, feature development, customer support, payment processing, and operational improvements. These third parties may be granted limited access to our systems, user data, and platform infrastructure solely for the purpose of performing their designated services. All third-party service providers are bound by strict confidentiality agreements, data protection obligations, and security protocols to safeguard your information and maintain platform integrity. However, FxLvl is not liable for any unauthorized access, data breaches, or security incidents resulting from third-party actions beyond our reasonable control.
9. Service Modifications and Platform Changes
FxLvl reserves the right, at any time and without prior notice, to: (a) Modify, update, enhance, or discontinue any aspect of our services, features, evaluation programs, or platform functionality; (b) Adjust pricing structures, fee schedules, profit split percentages, or payout terms for new programs (changes will not retroactively affect active programs unless legally required); (c) Temporarily suspend or permanently discontinue specific trading instruments, account types, or program offerings; (d) Implement technical upgrades, security patches, or infrastructure improvements that may result in temporary service interruptions; (e) Change trading platform providers, broker partnerships, or execution infrastructure. We will make reasonable efforts to provide advance notice of material changes where feasible, but we are not obligated to do so. FxLvl shall not be held liable for any losses, damages, or inconvenience resulting from service modifications, temporary unavailability, or platform changes.
10. Information Accuracy and Platform Content
While FxLvl strives to maintain accurate, current, and reliable information on our website and platform, we do not guarantee the completeness, accuracy, timeliness, or reliability of any content, market data, educational materials, performance statistics, or other information provided through our Service. Market conditions, pricing data, economic indicators, and trading information may be subject to delays, errors, or inaccuracies. You acknowledge that you use all platform content at your own risk and agree to independently verify any information before making trading decisions. FxLvl disclaims all liability for errors, omissions, outdated information, or inaccuracies in any content provided through our Service.
11. Third-Party Tools and External Integrations
Our platform may provide access to, or integration with, third-party trading tools, market analysis software, charting platforms, news feeds, economic calendars, or other external services. Your use of any third-party tools or services is entirely at your own risk and may be subject to separate terms and conditions, privacy policies, and user agreements established by those third-party providers. FxLvl does not endorse, guarantee, or assume any responsibility for the accuracy, reliability, security, or performance of third-party tools. You agree to review and comply with all applicable third-party terms and acknowledge that FxLvl is not liable for any issues, damages, or losses arising from your use of external integrations.
12. Data Collection and Privacy Protection
The collection, use, storage, and protection of your personal information are governed by our comprehensive Privacy Policy, which is incorporated into these Terms by reference. By using our Service, you expressly consent to the collection and processing of your personal data, trading information, financial details, and usage analytics in accordance with our Privacy Policy. This includes, but is not limited to: (a) Identity verification and KYC/AML compliance data; (b) Trading performance metrics, account activity, and transaction history; (c) Communication records, support tickets, and correspondence with our team; (d) Technical data such as IP addresses, device information, browser type, and usage patterns. We implement industry-standard security measures to protect your data, but you acknowledge that no system is completely secure and that you use our Service at your own risk regarding data security.
13. Risk Disclosure and Trading Acknowledgment
TRADING INVOLVES SUBSTANTIAL RISK OF LOSS. You acknowledge and agree that: (a) Trading foreign exchange, contracts for difference (CFDs), commodities, indices, and other leveraged financial instruments carries a high level of risk and may not be suitable for all individuals; (b) You may lose some or all of the capital allocated to your trading account; (c) Past performance, whether your own or that of other traders, is not indicative of future results; (d) Leverage can magnify both profits and losses; (e) Market volatility, liquidity constraints, execution delays, and slippage can significantly impact trading outcomes; (f) You are solely responsible for understanding the risks associated with trading and for implementing appropriate risk management strategies; (g) You should only trade with capital you can afford to lose without impacting your financial well-being. FxLvl strongly recommends that you educate yourself thoroughly on trading risks and seek independent financial advice before participating in our programs.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FXLVL AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, PARTNERS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO: (a) Loss of profits, revenue, or anticipated savings; (b) Loss of data, information, or business opportunities; (c) Costs of procurement of substitute services; (d) Trading losses resulting from platform errors, execution delays, data inaccuracies, or system failures; (e) Damages arising from unauthorized access, data breaches, or security incidents; (f) Any other losses or damages arising from your use of, or inability to use, our Service, whether based on contract, tort, negligence, strict liability, or any other legal theory, even if we have been advised of the possibility of such damages. Our total aggregate liability for all claims arising from or related to these Terms or your use of the Service shall not exceed the total fees you have paid to FxLvl in the twelve (12) months preceding the claim. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED ACCESS.
15. Indemnification
You agree to indemnify, defend, and hold harmless FxLvl, its parent companies, subsidiaries, affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable attorneys' fees and legal costs) arising from or related to: (a) Your violation of these Terms or any applicable laws or regulations; (b) Your use or misuse of the Service; (c) Your trading activities, whether during evaluation or live trading phases; (d) Any false, misleading, or fraudulent information you provide; (e) Your infringement of any intellectual property rights or other rights of third parties; (f) Any disputes between you and other users or third parties; (g) Your negligence, willful misconduct, or unlawful conduct. This indemnification obligation survives the termination of these Terms and your relationship with FxLvl.
16. Dispute Resolution and Governing Law
These Terms shall be governed by and construed in accordance with the laws of [YOUR JURISDICTION], without regard to its conflict of law provisions. We reserve the right to pursue legal action to recover damages, legal fees, and costs associated with fraudulent disputes.
17. Intellectual Property Rights
All content, software, technology, trademarks, service marks, logos, trade names, designs, graphics, images, text, and other intellectual property displayed on or through our Service are the exclusive property of FxLvl or our licensors and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use our Service for its intended purpose in accordance with these Terms. You may not: (a) Copy, reproduce, distribute, modify, or create derivative works from any FxLvl content without express written permission; (b) Use our trademarks, logos, or branding in any manner without prior authorization; (c) Remove, alter, or obscure any copyright, trademark, or proprietary notices; (d) Frame, mirror, or replicate any portion of our Service on other websites or platforms. Unauthorized use of FxLvl's intellectual property may result in legal action and liability for damages.
18. Severability and Waiver
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, it shall be severed from these Terms. The remaining provisions shall continue in full force and effect. No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or any other term, and FxLvl's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
19. Changes to Terms and Conditions
FxLvl reserves the right to modify, amend, or update these Terms at any time, at our sole discretion. We will provide notice of material changes by posting the updated Terms on our website with a revised "Last Updated" date, and in some cases, we may provide additional notice via email or platform notification. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. 20. Entire Agreement and Contact Information
